For example, a product family of "ceramic capacitors" contains a large number of part numbers (e.g. for different values of capacitance) but all of the part numbers are manufactured using the same set of materials and so all part numbers have the same compliance status for RoHS, REACH etc. The BOMcheck Regulatory Compliance Declaration tool reduces REACH compliance costs by 66% by enabling suppliers to screen out SVHCs which are not normally found in found in parts and materials in the electrotechnical industry and providing detailed chemicals guidance for the remaining substances. Using the BOMcheck tools to create a Regulatory Compliance Declaration for a list of part numbers is an 8 step process: 1. Create your parts list in Excel by including the part number in column 1, the part name in column 2 and the part weight in column 3. Do not include a header or title row and do not include data in any other columns. Save your file as a Unicode text file. 2. Login to www.BOMcheck.net and select 'Enter Data' and then select 'Add Declaration' and you will see the tool to make a Regulatory Compliance Declaration. Select 'Browse' to attach the list of part numbers, part names and part weights and then use the drop-down boxes to specify the unit of weight (kg, gm, mg or µg) and the material unit (each, centimeter, meter, square centimeter, square meter, cubic centimeter, liter or cubic meter). 3. Complete the Regulatory Compliance Declaration for the parts list. 4. Attach PDF evidence documents (e.g. RoHS test certificates if available) to support your declaration, if necessary. 5. Enter the date that the declaration is valid from. This can be a date in the past if the declaration has been valid for some time. 6. Type in the title of the parts list which is attached to the declaration (e.g. ceramic capacitors). The declaration title will help you to locate your parts list in your Account Overview screen if you need to change or update the declaration details for your parts list in the future. 7. Choose whether to make the declaration confidential so that it can be only be viewed by certain manufacturers. 8. Preview the declaration, approve it and then sign it with your electronic signature by typing in your password. Congratulations! Your declaration is now published in BOMcheck and your customers can now access the compliance information for your part numbers.

Companies’ obligations to inform their customers about 168 REACH Candidate List Substances of Very High Concern (SVHC) in their products changed on 10 September 2015 following the European Court of Justice (ECJ) ruling. Companies now have to inform their customers if any articles in their products contain more than 0.1% of an SVHC by weight of the article, instead of by weight of the product, and provide information on safe use according to European Chemicals Agency (ECHA) new guidance published 17 December 2015. BOMcheck Version 4.9 was implemented on 6 July 2017 and includes the new REACH SVHC that the European Chemicals Agency should have added to the REACH Candidate List today, 6 July 2017. The addition of this one new substance to the REACH Candidate List is delayed by paperwork at the European Commission. However, ECHA has provided the draft Press Release to BOMcheck which confirms all necessary details about this new substance. To allow suppliers time to start investigating this new SVHC before the summer holidays start, we have gone ahead and updated BOMcheck today, 6 July 2017, for this new REACH Candidate List substance. BOMcheck Version 4.9 also includes the following amendments to other lists in BOMcheck • New substance restrictions for ‘Pentachlorophenol (PCP)’ and ‘Fluorinated Greenhouse Gases (PFC, SF6, HFC)’ have been added to the BOMcheck list of ‘Substances restricted or declarable by other legislation’. • A new substance restriction for ‘Perchlorates in all batteries’ has been added to the BOMcheck list of ‘Battery substance restrictions’. • A new industry restriction for ‘Alkylphenol and alkylphenol ethoxylates’ in textile and leather articles has been added to the BOMcheck list of ‘Industry restricted and declarable substances’. In addition, BOMcheck Version 4.9 now supports the new COCIR list of Restricted and Declarable Substances for Medical Devices, which is published on the BOMcheck website. BOMcheck Version 4.9 includes a new Product Scope question which requires the supplier to confirm whether their parts can be used in Medical Devices. If the supplier confirms that yes, their parts can be used in Medical Devices then the supplier is required to complete the additional substance restrictions for Medical Devices which are now included in BOMcheck. If the supplier states that the part can not be used in Medical Devices then these Medical Device substance restrictions are not displayed to the supplier. If you have created full materials declarations then you do not need to take any action. The regulatory compliance declarations which BOMcheck generates from your full materials declarations have been updated automatically for these new substance restrictions. This webinar is for people who have created regulatory compliance declarations and so you need to understand what types of materials these new regulated substances can be found in, and how to update your regulatory compliance declarations for these new substances. The webinar concludes by demonstrating how you can update an individual regulatory compliance declaration in your supplier account and how you can also choose to update all of the regulatory compliance declarations that you yourself have made the supplier account for specific substances in one go.

Material declaration data exchanges can be time consuming and difficult. Certain directives, such as the European Union RoHS Directive, place restrictions on the use of specific materials and substances in products. In 2005, the JIG101 joint industry guide materials composition declaration for electronic products was released to identify materials and substances required for disclosure. This guide was then superseded by the IEC 62474 material declaration standard. The Institute of Printed Circuits (IPC) and its associates created a data exchange standard to support these initiatives, as well as ones that will develop in the future. The IPC-1752 standard establishes a common reporting format for material declaration data exchanges throughout the entire supply chain. The current version of the standard, IPC-1752A, is a reporting format in an XML Schema that supports various classes of material declarations: Class A, Class B, Class C and Class D. The standard supports reporting of bulk materials, components, printed circuit boards, sub-assemblies and products. The IPC-1752A standard is supported by third-party solution providers which allow users to create, change and read the standard’s XML Schema. In 2017, the European Chemicals Agency clarified the definition of an "Article" under EU REACH, which changes the way that your Substances of Very High Concern (SVHC) totals are calculated. Companies affected by EU REACH may declare that their products contain no SVHC substances of more than 0.1%, but if you are still calculating based on the weight of the product as a whole instead of the weight of each individual component, you could be making an inaccurate declaration. This webinar explains the new Proposition 65 warning methods and content which take effect in California from 30 August 2018, highlights how Proposition 65 compliance is enforced by private ‘bounty hunter’ attorneys, and demonstrates how the screening assessment which is published inside BOMcheck helps companies reduce the time and cost for Proposition 65 compliance by 97%. Proposition 65 requires the Governor of California to publish a list of chemicals known to cause cancer or birth defects or reproductive harm, and for businesses with 10 or more employees to provide “clear and reasonable” warnings if their products expose individuals to any Proposition 65 substance above “safe harbor” levels. The list currently includes more than 900 chemicals and the California Office of Environmental Health Hazard Assessment (OEHHA) updates the list regularly. In August 2016 OEHHA introduced new regulations which change the “safe harbor” warnings which are deemed to comply with the law. The new “safe harbor” warning methods and content take effect from 30 August 2018. California empowers private citizens, working with ‘bounty hunter’ attorneys, to enforce compliance with these Proposition 65 warning requirements. In the past 17 years the number and size of the settlement payments carried out by private ‘bounty hunter’ attorneys have trebled, from around $10 million dollars in 2000 to around $30 million in 2016. There are more than 900 substances on the Proposition 65 list. Dr Paul Goodman at RINA consulting has produced a screening assessment which is published inside BOMcheck and helps companies the time and cost for Proposition 65 compliance by 97%. Dr Goodman’s screening of the 900+ Prop65 substances, supported by detailed investigations by BOMcheck (including checking relevant Prop65 settlements in California), found that • 105 substances may be found in component parts of mechanical or electrical products • 39 of these substances do not require “safe harbor” warnings, for example Indium Phosphide is a crystalline solid located inside electronic components which are located inside products • 66 of these substances may require “safe harbor” warnings BOMcheck has taken the screening to another level by identifying that 29 of these 66 substances are already regulated under RoHS, REACH substance restrictions, POPs regulation or REACH Candidate List in BOMcheck with the appropriate threshold levels. In other words, if supplier parts are already compliant to the RoHS, REACH substance restrictions, POPs regulation and REACH Candidate List in BOMcheck then there are only 37 new substances that suppliers need to provide compliance declarations for Proposition 65. The BOMcheck reporting tools produce a report on whether the suppliers’ parts contain any of the list of 66 Prop65 risk substances by combining the suppliers’ declarations data for the 37 new Proposition 65 substances with the suppliers’ declaration data for the 29 Proposition 65 substances which are already regulated under RoHS, REACH substance restrictions, POPs regulation or REACH Candidate List in BOMcheck.

On June 28, 2017 the European Chemicals Agency released an update to their guidance on requirements for substances in articles. This guidance, for the REACH Regulation, clarifies communication requirements for substances of very high concern (SVHCs), in relation to the Court of Justice of the European Union's (CJEU) 'once an article always an article' ruling. The ruling was necessary in response to a number of EU Member States who did not agree with the interpretation. France was committed to enforcing REACH under their own interpretation of the 'once an article always an article' ruling. This resulted in two French trade associations requesting a ruling from the European Court of Justice. Prior to the updated guidance, companies have been adapting without official guidance from the European Chemicals Agency. The ruling states that SVHC compliance should be based on concentration thresholds for each individual article within a product or object, not the product as a whole. This was a game changer for industry. With this release, suppliers and importers now have the context they need to assess compliance with the requirements of Article 33 and Article 7(2) of the REACH Regulation. The improvements offer a more comprehensive set of examples to help them understand the conditions under which they must communicate the composition of their products. This is a strong signal that the ECHA will continue to provide further and ongoing industry guidance in relation to the REACH Regulation.
